Welcome to Pixel Hashtag. By using our services, you agree to comply with the following Terms of Service. Please read them carefully. If you do not agree to these terms, you should not use our services.
1. Services
Pixel Hashtag provides digital marketing services, including but not limited to Branding, Social Media Marketing, Search Engine Optimization (SEO), Website Development, Lead Generation, and Graphic Designing. Specific terms and conditions related to each service may be outlined in separate agreements.
2. Payment Terms
- A 50% advance payment is required before project commencement, with the remaining balance due before the project goes live.
- Payments must be made via NEFT, RTGS, Cheque, Debit/Credit Card, or PayPal (a 5% processing fee applies to PayPal and credit card transactions).
- Late payments will incur a 0.5% daily late fee on the outstanding amount, along with a ₹2000 administrative charge per month after the due date.
3. Cancellations & Refunds
- If a project is canceled before work has started, 50% of the amount paid will be refunded.
- If work has already begun, no refunds or adjustments will be made.
- All cancellation requests must be in writing; verbal or phone cancellations will not be accepted.
4. Project Delays & Stalling
- Clients must provide all necessary materials (text, images, videos, etc.) within two weeks of project commencement.
- If a project is stalled for more than a month due to client-side delays, Pixel Hashtag may charge an additional 10% of the total project cost per month as a delay fee.
- Failure to provide necessary content in time may result in project termination, with all outstanding balances becoming immediately payable.
5. Ownership & Portfolio Rights
- Upon full payment, clients own the final website, design, or marketing materials.
- Pixel Hashtag retains the right to showcase completed projects in its portfolio unless explicitly agreed otherwise.
- A design credit line will be placed at the bottom of the website unless the client opts out by paying an additional 20% of the total project cost.
6. Third-Party Services & Expenses
- Clients agree to bear any costs for additional services, including stock images, fonts, plugins, SSL certificates, hosting, and third-party integrations.
- If the client hosts a website on an external server, any additional technical support required will be charged separately.
7. SEO, Paid Ads & Digital Marketing Services
- SEO results depend on multiple factors, including search engine algorithm changes. No guarantees are made for first-page rankings on single-word generic keywords.
- Paid ad campaigns are subject to changes by ad platforms (Google, Facebook, etc.), and Pixel Hashtag is not responsible for any policy changes or account restrictions imposed by these platforms.
- All media/ad spends are prepaid and paid directly by the client.
- A minimum six-month commitment is required for guaranteed SEO performance on 20-35% of targeted keywords.
8. Termination
- Either party may terminate the agreement with two months’ written notice.
- If no notice is provided, the terminating party will be required to pay a two-month proportional service fee.
- Clients agree not to hire or offer employment to Pixel Hashtag employees directly. Any breach of this term will result in a penalty equal to 12 months of the employee’s salary.
9. Liability & Indemnification
- Pixel Hashtag is not responsible for downtime, data loss, or security breaches due to third-party services or unforeseen circumstances.
- The client agrees to indemnify Pixel Hashtag against any claims, damages, or legal disputes arising from the use of our services.
10. Governing Law
This agreement is governed by the laws of India, and [Your City, e.g., Mumbai] shall be the exclusive jurisdiction for any disputes.
